Judge grants church's plea to bolster COVID lawsuit, notes changing mood of courts

Pastor Rob McCoy and the Newbury Park church he leads will be allowed to bolster their lawsuit filed against the county over coronavirus restrictions, a Ventura County judge ruled Tuesday.

Superior Court Judge Henry Walsh said the courts freely allow parties in litigation to amend their lawsuits and that the state of the law is evolving on religious restrictions.

He cited in particular a Los Angeles Times story reporting comments made early this week by judges in the U.S. Ninth Circuit Court of Appeals. Based on his reading, the  federal court signaled it was going to modify previous rulings viewed as too restrictive on churches. Walsh did not elaborate, but the issue reportedly centers on the prohibitions on indoor worship services. 

McCoy and Godspeak Calvary Chapel have defied public health orders banning indoor services for months, arguing that the rules infringe on religious liberty and prevent fellowship that congregants need. 

Under Walsh's ruling, McCoy and the chapel were allowed to add claims that the restrictions violate the U.S. Constitution along with their original claims of violations of the state Constitution.

Constitutional claims 

The church is now claiming violations of rights guaranteed under the First Amendment, such as free exercise of religion, freedom of speech and assembly and a provision forbidding the government's establishment of religion. Also added was a claim that the restrictions violate the right to equal protection under the California Constitution and the 14th Amendment to the U.S. Constitution. 

The decision is the latest in a series of rulings since the county sued McCoy and the Godspeak Calvary Chapel in early August over their refusal to stop holding indoor worship services. The county has won most of those rounds as judges ordered compliance, held the church and McCoy in contempt and issued a $3, fine against the church that has not yet been paid.

The county government and county Public Health Officer Dr. Robert Levin said the church should not be able to amend its complaint. Their opposition was based on the minister's and the church's repeated defiance of court orders, a county lawyer said.

The court should not "condone such behavior" by allowing the lawsuit to be amended at a time when cases are surging, Assistant County Counsel Jaclyn Smith told the judge.

Walsh, though, did not see court intervention as the answer. If the church flouts the restrictions, shouldn't the sheriff be asked to enforce them, he asked.

Ventura County once sought a court order to direct Sheriff Bill Ayub to immediately take necessary actions to close the church to prevent indoor worship services, but a previous judge handling the case denied it.

The changes are to be made in a counter-lawsuit that McCoy and the church filed against the county along with public health officials. Gov. Gavin Newsom is also expected to be named. The counter-suit was filed after the county and Levin sued the church and McCoy over his refusal to stop holding indoor services.

Changing legal landscape

In a tentative written ruling issued before the hearing, Walsh supported the addition of the amendments based on standard practice and his view that the legal landscape in the area of restricting religious services in the COVID arena is changing.

He cited the U.S. Supreme Court's recent decision to strike down an order by Gov. Andrew M. Cuomo that had restricted the size of religious gatherings in some areas of New York and said he believed there had been some modifications on limitations in the Los Angeles area.  

"This is not meant to telegraph any view of the court that religious gatherings should get an exemption, only that there has been some change in this area of governmental reaction to COVID," he wrote.

McCoy, who was in Phoenix and did not attend the hearing, said he was grateful for the judge's ruling.

"I think it is a wise decision," based on the high number of people who survive infection with the virus, he said.

He questioned whether the mortality rate justifies what he considers violations of the First Amendment and the Fifth, which requires government to compensate citizens when private property is taken for public use.

"We have devastated businesses," he said. "It's almost as if the cure is worse than the virus itself."

Acting County Counsel Michael Walker could not immediately be reached for comment.

Judge issues injunction against Newbury Park chapel; pastor plans to keep defying court

Editor's note: This story has been updated to show that the fatality rate in Ventura County stands at % out of the total number of confirmed cases.

A judge issued a preliminary injunction Monday to force the Godspeak Calvary Chapel and Pastor Rob McCoy to stop holding indoor worship services, but McCoy said afterward that the Newbury Park church won't comply.

The injunction replaces a temporary restraining order issued two months ago, a short-term measure that courts take to gain compliance. A preliminary injunction typically lasts until the matter goes to trial and a judgment is rendered.

That could be many months away although it's possible that the public health orders forbidding indoor services could be lifted by then because the county will have met the state's standards for containing COVID 

The church's attorneys asked Ventura County Superior Court Judge Vincent O'Neill Jr. not to impose the injunction, saying that neither the law nor the amount of reported disease justifies the closures of indoor services they argue infringe on religious liberty.

O'Neill said the First Amendment and the right to practice religion are treasures to be carefully guarded, but that at this point he believes the county government's position forbidding indoor services to protect public health is the right one. 

Judge, Godspeak attorneys clash

Attorneys for the church cited declarations from health specialists, and the findings of a county study that showed eight of 2, people tested positive for COVID had attended a religious service within a day period prior to their diagnosis. Additionally, they said the emergency that existed in the early days of the pandemic in March no longer applied.

"This cannot be the new normal," attorney Nada Higuera said.

O'Neill said he found the defense experts had impressive qualifications and were making arguments that needed attention, but that attention would come at trial if the case goes that far.

He also asked about the % fatality rate cited for Ventura County by the defense, based on deaths recorded among 12, positive cases. He said even that rate might be too high because of the number of people with no symptoms who have not been tested.

County Health Director Rigoberto Vargas said Tuesday that the fatality rate is about %, based on the number of deaths in all confirmed cases. 

O'Neill did not want to overrule the findings of county and state public health officials on measures that should be taken to contain the pandemic, citing an opinion written by Supreme Court Chief Justice John Roberts in a separate case.

"When there is uncertainty such as in a medical or scientific area, the discretion is broad upon the officials charged with that responsibility," he said at the end of the hearing in Ventura.

O'Neill said the actions taken by the government are presumed to be constitutional unless there is something that suggests otherwise from either the nature or face of the action.  

"I don't think we have that here," he said. 

How did this all start?

Ventura County and its public health officer sued the church and McCoy in August, alleging they had violated both state and local public health orders and had caused a public nuisance.

They requested a temporary restraining order, which Superior Court Judge Matthew Guasco issued within days. He forbade the defendants from holding indoor worship services at the chapel or any other venue in Ventura County.

They have continued to do so, which led to a finding of contempt that is still in force.

A number of other churches have complied by holding services outdoors, which is allowed by the county and the state.
