UCSD may tighten regulations on scooters, bikes and skateboards due to safety issues

UC San Diego might ban some types of bikes and tightly regulate other “micromobility” devices to ensure safety on a campus whose roads and pathways have become jammed as enrollment soared to nearly 40,000.

The university has drafted proposed regulations that call for outlawing gasoline-powered and gasoline-assisted devices, which typically refers to a class of bikes. Hoverboards also would be banned.

UCSD would permit the use of small, manually or electrically-powered vehicles, including regular bikes, e-bicycles, scooters, e-scooters, one-wheels, and skateboards.

People who use the devices “may not carry passengers or objects that impede their balance, ability to travel at a safe speed, or safely and efficiently steer or stop the vehicle,” UCSD said in an email sent to the entire campus on Nov. 5.

The university also proposes to ban operators from wearing headsets, earplugs or earphones “resting on, or inserted in, both ears” while operating the device.

It’s become common to see pairs of students riding around campus on a single e-scooter over the past year as the number of micromobility devices increase. So has the sight of people wearing earplugs or ear phones will operating scooters.

UC San Diego has been promoting its “Slow your Roll” campaign in an attempt to prevent accidents and injuries on campus byways.

They have joined skateboards and cyclists in competing for space on the increasingly congested byways, especially Library Walk and Ridge Walk.

“Students are upset about this,” said Ethan Coston, managing editor of the Triton, a student-run news website. “There have been a lot of bike and skateboard accidents. I got hit by a skateboard.

“And people are riding through the crowds in places where you’re supposed to walk your bike.”

Sophomore Blythe Rinehart-Pimentel told UCSD’s other website, The Guardian, that, “I also think that there are a lot of other ways to make campus mobility safer including limiting pedestrian use of cell phones, [building] wider roads and pathways to accommodate more people, limiting hours or routes of certain larger carts, and enforcing the speed limit for bikes and other micromobility devices.”

The university’s original master plan, released in 1963, envisioned that UCSD would have about 27,500 students when the school was fully developed. But the university began the fall 2019 quarter with 39,634. And UCSD envisions growing to at least 42,500. The growth has been cramming walkways with far more students than the campus ever expected to have.

Sequencing Study Points to Prenatal Development Syndrome, Possible Treatment Strategy

NEW YORK – An international team led by investigators in the US and Singapore has identified a syndrome linked to mutations affecting both copies of the "Wnt ligand secretion mediator"-coding gene called WLS that affects the prenatal development of multiple organ systems.

"Our genetic findings provide evidence of impaired WLS function as a cause for this new condition," co-senior and co-corresponding author Joseph Gleeson, a neurosciences and pediatric brain disease researcher affiliated with the University of California, San Diego and the Rady Children's Institute for Genomic Medicine, and his colleagues wrote in the New England Journal of Medicine on Thursday, adding that results from their mouse model experiments "suggest that pharmacologic intervention could be considered for some structural birth defects during gestation."

The researchers identified the condition — dubbed Zaki syndrome, in honor of co-author Maha Zaki at the National Research Center in Cairo — using a combination of linkage analyses, whole-genome sequencing, or exome sequencing on affected children and/or parents from families affected by similar unexplained neurodevelopmental conditions and structural birth defects.

Starting from nearly 20,250 neurodevelopmental disorder-affected families from international databases, they focused in on cases involving microencephaly or structural birth defects and comparable symptoms ranging from sparse hair and eyebrows, heart or kidney problems, and webbed toes to cupped ears and facial dysmorphic features.

By digging into the linkage and sequence data, the team identified 10 affected individuals with homozygous pathogenic or likely pathogenic WLS alterations that led to lower-than-usual WLS protein levels in primary dermal fibroblast cell experiments. The cases came from five families, including one family that had five children affected by the congenital condition. Consistent with the recessive nature of the condition, three of the five families involved parental consanguinity. 

The researchers noted that tissue, cellular, or developmental abnormalities also turned up in follow-up experiments on WLS-mutant mouse embryonic fibroblast cell lines or in mouse embryos carrying WLS variants found in two of the patients — Wnt signaling shifts that could be rescued in mice using a Wnt agonist compound called CHIR99021 given during the process of embryonic development.

"The results were very surprising because it was assumed that structural birth defects like Zaki syndrome could not be prevented with a drug," first author Guoliang Chai, a researcher at the Capital Medical University in Beijing, who was a post-doctoral researcher at UCSD when the research was performed, said in a statement. "We can see this drug, or drugs like it, eventually being used to prevent birth defects, if the babies can be diagnosed early enough."

Gleeson cautioned that studies of the proposed Wnt agonist treatment have been done strictly in mouse models so far, though the rise in fetal molecular testing and diagnoses may eventually help to uncover human Zaki syndrome cases prenatally, when they may benefit from a preventive treatment similar to that assessed in mice.

"Currently there are not clinical trials planned, but if enough patients are identified we will initiate a clinical trial," Gleeson said in an email, calling it "unethical to not at least consider how the babies might benefit from treatment."

Likewise, the authors noted that the potential use of Wnt agonists such as CHIR99021 after birth has not yet to be explored in Zaki syndrome models, though they suggested that "we do not rule out potential benefit, because we suspect that most future diagnoses of this condition will be made after rather than before birth."

The UCSDGuardian is a student-operated newspaper at the University of California, San Diego. Originally named the Triton Times, it is published once a week during the regular academic year, usually Mondays.[1] Although The Guardian is officially a university department, it is funded solely by advertising. Unlike many college newspapers, The Guardian has no faculty advisor and is not formally tied to any academic program.[citation needed]

Staff structure[edit]

The Guardian's editorial staff consists of UCSD undergraduates. The Editor in Chief is elected in the late spring by a vote of the current year's staff; the Editor in Chief-elect then selects new senior editors, who make up the paper's Executive Board, which is ratified by the outgoing editors.[citation needed]

In contrast, the paper's business side is operated by several longtime university employees. A Business Oversight Board, which includes the paper's general manager, Editor in Chief, and managing editors, is responsible for setting long-term policies for the business and overseeing their implementation.[citation needed]

University relationship[edit]

Though The Guardian is technically a self-supporting enterprise under the university's Student Affairs department, it operates with complete independence and autonomy from the university. Under the paper's constitution, the Executive Board operates as the sole publisher of the paper. The newspaper's student editors have formally resolved to cease its production and operations in the case of any university interference.[citation needed]

Recent history[edit]

In recent years, the paper has undergone a series of crises and resulting restructurings. Between 2001 and 2004, The Guardian saw its annual revenue plunge, from above $400,000 to less than $320,000. The resulting budget deficits nearly wiped out the paper's financial reserves and resulted in page reductions for its editorial operations.[citation needed]

As part of an effort to stop the bleeding, the paper's general manager implemented a strict 50-50 division between editorial content and advertising. The Executive Board of the paper responded to the crisis by carrying out a reorganization of the business department and a reduction in the compensation of its student staff.[citation needed]

Editorial success[edit]

Throughout the years, The Guardian has won many local, regional, statewide, and national awards. In 2006, The Guardian won nearly a dozen and a half awards from the California College Media Association, in categories ranging from design and illustration to writing and photography. Shortly after, the paper was also named an honorable mention in the competition to be named Newspaper of the Year by the Associated Collegiate Press.[citation needed]

In 2020, The Guardian won several awards from the San Diego Society of Professional Journalists, including second place for Best College Newspaper, first place for Best Arts & Entertainment Story in a College Publication, and third place for Best Opinion in a College Publication.[2]The Guardian also won several awards from the San Diego Press Club, including first place for Best Column in a College Publication, second place for Best Investigative Reporting in a College Publication, and an honorable mention for Best Student Newspaper. While UCSD does not have a journalism program, many former Guardian writers and editors have launched journalism careers. Guardian alumni have worked or currently work for major newspapers (including The Wall Street Journal, the Orange County Register, Kansas City Star, the Seattle Post-Intelligencer, The San Diego Union-Tribune, the Riverside Press-Enterprise, The Torrance Daily Breeze, The Christian Science Monitor, Investor's Business Daily, LA Weekly, SF Weekly and the Los Angeles Times), magazines (including Newsweek, Vanity Fair, Flaunt and Macworld), and television news stations (KGTV-San Diego).[citation needed] In 2006, an alumnus was nominated for the Academy Award in the Documentary Short category.[4]

Change in frequency[edit]

During fall quarter 1990, The Guardian published three issues a week, on Mondays, Wednesdays, and Fridays. Due to a lack of advertising revenue and the increased production and distribution costs of a third issue of the newspaper, the paper reverted to a twice-weekly schedule during winter quarter 1991. The Guardian was published twice weekly, on Mondays and Thursdays, until winter quarter 2017, when the switch to a weekly schedule was made.[citation needed]

At the beginning of spring quarter 2020, The Guardian temporarily ceased its print publication and made the transition to release all content on its website and in a weekly newsletter. This change was made due to the ongoing COVID-19 pandemic.

The Disreguardian[edit]

In the early 1980s The Guardian published several April Fool's Day issues, titled The Disreguardian. The practice stopped at some point, but was revived on April 1, 1990, a decision that resulted in Editor-in-Chief Seth Slater's resignation in protest. The April Fool's issues continue to this day.[citation needed]

Behind the Scenes at UCSD: ‘Guardian’ Shows the Lengths Student Government Went to Gain Control of Media

After three weeks of heated debate at the University of California, San Diego (UCSD), FIRE announced yesterday that the Associated Students of UCSD (ASUCSD) has finally restored funding to the 33 student media organizations whose quarterly funding was frozen by ASUCSD President Utsav Gupta following the utterance of a racial slur on UCSD’s student-run television station.

The UCSD student newspaper The Guardian points out that, according to the Standing Rules of the ASUCSD, the governing body was required to do so:

According to the A.S. Standing Rules, a funding freeze is automatically lifted by Wednesday of Week 10 if the council doesn’t pass legislation that counters that rule. By default, council returned to funding media organizations with the same system as before.

But as The Guardian points out as well, it was a fight to the finish; its editorial board describes the scene of Wednesday’s ASUCSD meeting as "mayhem." The California Review‘s Alec Weisman has posted video footage of the entire meeting, which backs up The Guardian‘s assertion.

But for a principled stand by a majority of the ASUCSD, Wednesday night’s proceedings could have resulted in a drastic reduction of the rights of UCSD’s student media organizations and the consolidation of all power over their funding into the hands of one ASUCSD member. Fortunately, the AS Council shot down this option, put forth by ASUCSD Vice President of Finance and Resources Peter Benesch, who stood to gain near-total control over the student media had it passed. Benesch himself describes his proposal as such:

"Essentially, this idea supposes that we will close the open forum where everyone can come and ask for money and we have to distribute in a viewpoint-neutral manner, and move to a model where the A.S. will have to provide a large amount of funding through advertising initiatives," Benesch said.

A writer for TheGuardianput it better:

VP of Finance and Resources Peter Benesch said the heart of democracy is the ability to choose whose voice is heard over others.

Yikes. Making matters worse, whether or not a media organization would receive funding would depend on its adherence to UCSD’s Principles of Community—essentially giving disciplinary powers to what should be an aspirational set of requirements. We pointed out the dangers of this in our February 23 letter to UCSD Chancellor Marye Anne Fox:

Any determination by you or your administration that the Principles of Community are not merely aspirational, but rather comprise mandatory beliefs, attitudes, and demeanors, would unquestionably violate the First Amendment. For example, the Principles of Community state that UCSD is "committed to the highest standards of civility and decency toward all." As a statement of institutional values, without any possibility of official enforcement, this moral code is perfectly acceptable. But if this commitment to "civility and decency toward all" were to constitute required behavior, subject to punishment if not observed, then UCSD would be violating the First Amendment rights to freedom of expression and freedom of conscience of its students.

Unfortunately, Benesch’s proposal had its adherents, among them Senator Alyssa Wing, who stated that "[w]e’ve really been urged to do something to uphold the Principles of Community." (By whom, I wonder?) Student Regent delegate Jesse Cheng’s advocacy for Benesch’s proposal was similarly misguided:

"We stand for this protocol because this issue is an issue of diversity and not really an issue of free speech and even less an issue of the Constitution," Cheng said. "If it does come down to legality, it’s the Supreme Court’s responsibility … you don’t have to worry about that here."

Legality is the Supreme Court’s responsibility, according to the "Student Regent?" Double yikes.

An "opt-out" model was also considered, which would have allowed UCSD students to withhold a portion of their mandatory student activity fees from funding certain groups on personal moral grounds. One student advocated for such a model as "empowering students to make a decision with how the campus is run."

Asked for comment by TheGuardian, ACLU of San Diego & Imperial Counties Legal Director David Blair-Loy called both proposals unacceptable:

"There are numerous student orgs that engage in all forms of protected speech that aren’t print," Blair-Loy said. "A.S. has funded many forms of controversial speech, and they can’t treat student press differently from the way they treat other student orgs. The First Amendment doesn’t just protect freedom of speech, it protects freedom of the press."

He said that these two proposed systems violate Section 61.13 of the UC Regents policy, which states that student government must provide funding on a viewpoint-neutral basis.

"I never say preliminarily that I will sue before I do, but if A.S. adopts either of these options, their chance of being litigated will increase exponentially," Blair-Loy said.

Aside from the unconstitutionality of these proposals, especially Benesch’s self-aggrandizing "government speech" proposal, The Guardian‘s editorial board suggests that Benesch and Gupta were dishonest in their pursuit of this oppressive policy, and worked behind the back of the committee they had formed to consider possible revisions to the provisions for the funding of student media organizations. The committee, which included Kris Gregorian, Editor in Chief of The Koala—the controversial satirical paper at the center of the calls for censorship—was resistant to such drastic measures, and didn’t endorse either solution. The committee also did not put forth any proposed legislation of its own at the meeting.

Here’s how the The Guardian‘s editorial board describes the effort:

Which now looks suspiciously like a scheme, as everyone appointed to the committee had a similar stance: All were generally unwilling to recommend any funding model with content bias. So committee members — including Koala Editor in Chief Kris Gregorian and very vocal Sixth College Senator John Condello, a presidential candidate for spring — let their guard down, thinking they had this one in the bag. Gupta fooled them momentarily, moping around like a defeated servant of the people. He and partner-in-crime Vice President of Finance and Resources Peter Benesch stood by dopely while the rest of the committee trumpeted no-bars content-neutral funding, then wasted a week making friends and out-articulating each other on exactly the same points.

Gupta and Benesch were the odd ones out. They advocated an unpopular "government speech model" that would allow the council to fund only publications that aligned with its principles. Gupta assured the committee it shouldn’t bother with PowerPoints, and would only have to present a casual recommendation to the council.

The committee didn’t even bother to take an official vote on its stance, too busy waxing starstruck by Gregorian and drooling over the Bill of Rights. Condello literally set his feet up on the table during their final get-together (really more a wine garden than a meeting). So imagine the cool kids’ surprise when, at last night’s official media-funding presentation, Benesch whipped out the PowerPointed legislation for a government speech model — hoping to charm the council with nicely packaged research he had kept under wraps from the estranged committee.

In such a chaotic environment, with so many emotional students begging for action, there was the danger that councilmembers would join Gupta and Benesch under the pressure. But Benesch’s model was obviously terrible: Basically, every single newspaper would exist within the overly sensitive ideals of A.S.. Every newspaper would be an A.S. newspaper. Fortunately, that red flag flew above the mayhem, and the ‘Yes’ vote didn’t wildfire off the duo’s arson.

Gupta, of course, dismissed out of hand the possibility of any shenanigans on their part, calling the protests "scare tactics used by the majority to attempt to silence the minority." He went on to insist that the ASUCSD was a "moderate" body that would "continue to substantially fund media organizations." I assume, given his on-the-record statements, that "substantially" is a euphemism for "every publication except those that print content of which we disapprove."

Nice try, guys.

As I mentioned in the opener, it was in some ways a foregone conclusion that UCSD students would wake up on Thursday morning with some form of media rights restored; being either the (perfectly fine) status quo or Gupta and Benesch’s nuclear option, which would have made a mockery of the Constitution and made nearly certain a lawsuit against the university. But only one of those resolutions would have been satisfactory from the point of view of FIRE, the ACLU-SD, and the First Amendment. We’re pleased freedom of speech won out.

So if UCSD’s students think things have simply reverted to business as usual, I advise them to pick up the nearest copy of The Guardian to see just how close that came to not being the case—and I urge them to be vigilant regarding the possibility of future efforts to change the funding structure of their student media.
